Pennsylvania Department of Education – Alteration and/or Curtailment of Programs – the Kindergarten Discussion

The way I understand the situation from speaking directly to PDE (not anyone from the school district), is that since kindergarten is NOT a requirement in Pennsylvania, the PDE does not have authority to approve or deny an alteration or curtailment in the kindergarten program from full day to half day (or, quite honestly, from full day to no kindergarten – kindergarten does NOT have to be provided by any PA school districts). 

The choice to curtail or alter the kindergarten program lies with the school board, who I am sure will take advice and direction from the school solicitor, superintendent, school administrators, ect.

PURPOSE

Section 1124 of the School Code provides that: Any board of school directors may suspend the necessary number of professional employes, for any of the causes herein enumerated:

(1)   Substantial decrease in pupil enrollment in the school district;

(2)   curtailment or alteration of the educational program on recommendation of  the superintendent, concurred in by the board of school directors, approved  by the Department of Public Instruction, as a result of substantial decline in class or course enrollments or to conform with standards of organization or educational activities required by law or recommended by the Department  of Public Instruction

PROCEDURES

The Pennsylvania Department of Education will review requests for curtailment or alteration of the educational program of a school district using the following criteria:

  1. The Department will approve a school district’s request to curtail or alter an educational program if the district establishes that the curtailment or alteration is the result of a substantial decline in class or course enrollments. Generally, to establish that the curtailment or alteration is the result of a substantial decline in class or course enrollments, the school district must submit enrollment data, certified by the district Superintendent, which demonstrates the following:
    1. that enrollment in the class or course has decreased at least 20% from the school year five years prior; or
    2. that enrollment for the class or course is less than ten students.
  2. The Department will approve a school district’s request to curtail or alter an educational program if the district establishes that the curtailment or alteration is necessary to conform with standards of organization. Generally, to establish that a curtailment or alteration is necessary to conform with standards of organization, the school district, through information certified by the district Superintendent, must demonstrate that the requested curtailment or alteration will effect a change in the school or school district’s organization or curriculum that results in a more effective educational program.
  3. The Department will approve a school district’s request to curtail or alter an educational program if the district establishes that the curtailment or alteration is necessary to conform with educational activities recommended by the Department. To establish that a  curtailment or alteration is necessary to conform with educational activities recommended by the Department, the school district, through information certified by the district superintendent, must identify the specific department recommendation that serves as the basis for the curtailment or alteration. In determining whether to approve the curtailment or alteration, the department reserves the right to modify or withdraw any recommendation regarding educational activities that was previously issued.
  4. The Department will approve a school district’s request to curtail or alter an educational program if the district establishes that the curtailment or alteration is necessary to conform with educational activities required by law. To establish that a curtailment or alteration is necessary to conform with educational activities required by law, the school district, through information certified by the district superintendent, must identify the specific law that serves as the basis for the curtailment or alteration.

 

All requests must include a copy of the Board Action as recorded in the Board minutes as evidence of approval by the school district’s board of school directors.

For purposes of this section, certification that the district will remain in compliance with minimum curriculum requirements is not adequate proof that the curtailment or alteration is necessary to conform with educational activities required by law.

Boone seeks OK to make kindergarten half day

The Daniel Boone School Board voted 6-2 Monday to seek authorization from the state Department of Education to cut kindergarten classes to a half day from full day next year if needed to balance the budget.

Board members Alan D. Ross and Walter P. Sheehan voted no.

Board members who voted to submit the request said they don’t want to cut kindergarten hours but would like to have the option available in the event of a budget crisis.

“From a fiscal standpoint, we are going to be in a tight spot,” said Dr. Gary L. Otto, superintendent.

Federal funding cuts could create a financial hardship for the district, he said.

Debt concerns committee member

My comment:  I do try hard to limit any negative comments on my blog and simply present articles and topics as they come across in the media, however I truly hope what I am reading is inaccurate or that I am not understanding something clearly.  Any business, and I would think a school board with a $49+ million dollar budget, would wholeheartedly agree that long term budget planning would be a necessary step to success.  Although I realize a significant portion of the school’s budget comes from state funding, that does not excuse the practice of examining and establishing a long-term budget.  Did I read the $100 million debt figure correctly?  Did the paper miss a decimal point or something (I hope)?  How much of the $100 million is from building Amity Primary Center and Monocacy Elementary Center and what is the remaining debt?  And what does the interest look like on that debt?  What are the terms of that debt (how long will the district be paying on it)? 

This situation of the school board not all being on the same page as to how to financially run our school district is an example of why I URGE the parents and residents of the DB school district to start ATTENDING these important school board meetings so your voices can be heard.  There is not an end in sight with all the government budget cuts and our district and school board members will be faced with even more challenges in balancing NEXT year’s budget.  It’s difficult to make a significant impression on the school board when only  4 or 5 residents in the ENTIRE school district show up for a meeting.  Please don’t wait for a “hot topic” to come up to attend a meeting……the time is NOW.  Budget discussions for the NEXT school year have started.  Committee of the Whole meetings are the 2nd Monday of every month at 7:30 and the School Board meeting is the 4th Monday of every month.

The Daniel Boone School District’s financial committee has mixed feelings about a long-range approach to district budgets.

“We should consider looking a few years ahead as we work on our upcoming budget,” committee member Andrew Basile said at the panel’s meeting Thursday. “Every financial expenditure we make normally has a ripple effect on a future budget.”

Committee members Alan Ross and Kevin McCullough didn’t think so.

“You can’t predict what your revenues and expenses are going to be, especially in the economy that we’re in,” McCullough said. “So I don’t really see the value in spending time on a long-term budget.”

Basile’s feeling was that taxpayers should know the amount of debt the district is carrying. He said that as of June 2009, the district had $100,754,000 in debt.

“Right now, 14 percent of our budget goes to servicing the debt that this district has,” Basile said. “It’s a number that’s way too high and our residents should be aware of it.”

He noted financial rating organizations report that the district’s level of debt is well above average and affects its ability to borrow money.

“A four-year operating budget would let us see the long-term effects of the decisions that we make,” Basile said. “We’re basically a $50 million-a-year business that’s run on a year-to-year basis and being able to project out a few years would be an extremely effective tool.”

BCIU seeks to rent house from district

The Daniel Boone School District might become the second site of Transition House, a life skills program for special-education students.

The school district is in discussions with the Berks County Intermediate Unit, which is interested in renting a district-owned house on Chestnut Street at the entrance to Daniel Boone High School.

“It won’t make us rich, but it would bring some income into the district,” said Dr. Gary L. Otto, superintendent, in comments to the school board at its meeting Monday.

Nothing is final, but if discussions succeed, the location could be open as early as this fall, Otto said. The board authorized him to continue negotiations with the BCIU.

It’s unclear what alterations, if any, the house might need to accommodate the program, he said.

The district purchased the property in 2009, but it’s empty and there are no immediate plans for it.

Here’s my question …… I am not quite sure who to ask to get the accurate, unbiased answer.  From the information in this article, it does not sound as if the new, increased estimates/quotes were included in the original $3m approval for the stadium.  If that understanding is correct, then with these new estimated costs as well as other unforseen expenses that always seem to come up with most any construction, as well as the “up to $10 k” quote that was approved by the board a few meetings ago as expenses needed to hook up water and sewage to a temporary building for concessions that was not originally budgeted for……..what total cost of the stadium are we up to AT THIS POINT?  Does anyone know for sure?  Has anyone added it all up?  Does anyone care (besides me) to know this figure to this point.  I, could be wrong, but it doesn’t seem like we are in the ballpark of $3 million anymore, but over $4m?  Am I wrong?  Can someone with authority and knowledge publish an accurate quote?

Construction on the 209 required additional parking spaces at Daniel Boone School District’s renovated sports stadium will begin shortly and cost the district more than three times the estimate in April of $300,000.

The board approved the increased costs on July 20 when it awarded construction bids for the 209 phase one parking spaces.

B&J Excavating, Downingtown, Chester County, was approved as the general contractor, with the low bid of $940,000 and CC&M Construction, Reading, was approved as the electrical contractor with the low bid of $202,000.

“I did not give you accurate numbers in April and May when you needed to approve going forward with the additional 209 parking spaces,” said David Horn, president of Architerra Inc., Coopersburg.

Union Township has required that the 209 parking spaces be completed by Dec. 31 or the district will lose its occupancy permit for the sports stadium.

Horn said four items increased in price six days before the bids were due.

Those items include storm water management that increased from $105,000 to $327,471, erosion and sediment control that increased from $9,900 to $22,080 and the landscaping estimate increased from $14,300 to $100,400. Lighting increased from $15,000 to $202,000.

He said the cost of each space is $4,672.28, not including lighting.

“These are still the cheapest spaces, so watch out when you go for space 210,” said Horn.

“We have had to bring the total campus lighting into compliance and it is included in the bids,” said Horn, adding, “I don’t know where the $202,000 is going for lighting. I need to get my electrical engineer in here on that. The landscaping alone that is required is absolutely staggering in terms of the volume of plants we have to put in there.”

He said Union Township is following a mathematical formula for buffering and the board of supervisors won’t approve a partial landscaping waiver until the land development plans are approved.

Horn said he doesn’t want to hold up the approval process and won’t apply for the landscaping waiver.

The board also approved $82,288.16 in stadium construction cost overruns and $3,800 in credits.

Some credits and increased costs are for renovating the current concession building and installing the previously approved modular building as an additional concession building.

Purchase of the modular building was approved in June for use as restroom facilities.

Superintendent Dr. Gary L. Otto said the stadium will use portable toilets.

In addition, the board voted unanimously to not spend $21,925 to install a new turnstile gate with a wireless card reader at the stadium’s entrance due to the increased costs.

The cost of the gate was $13,500 and $8,425 for the wireless card reader.

Horn said the district could save $3,000 or more by installing the gate and card reader when the stadium project is complete and the district isn’t subject to the prevailing wage.
